Dawnbreaker Digital website terms of use

1. Who we are

This website is run by DAWNBREAKER DIGITAL SDN. BHD. (Registration No. 202601036231 (1698326-A)), a company incorporated in Malaysia ("Dawnbreaker", "we", "us"). We work with businesses in Malaysia. Our contact details are in clause 15.

2. What these terms cover

These terms apply to www.dawnbreakerdigital.com and demo.dawnbreakerdigital.com, and to the demos and examples on them (together, "the site"). By using the site you accept them. If you do not accept them, please do not use the site.

These terms do not cover the systems we build and run for our clients. Each client's use of its system is governed by the written agreement between that client and us, and a client's staff use the system under their employer's rules.

3. The site is information, not an offer

The site describes what we build and how we work. Nothing on it is an offer that you can accept to make a contract. We supply a service only under a written quote or agreement that you and we have both accepted. If the site and that quote or agreement say different things, the quote or agreement applies.

4. Prices

• What you pay depends on what you need, and we set it out in a written quote before any work starts.
• Prices exclude service tax (SST), which is added if applicable.
• A quote binds neither of us until you and we have both accepted it.

5. Demos, examples and figures

• The demos run on made-up businesses, people and figures. Any likeness to a real business or person is a coincidence.
• What you type or tap in a demo is kept in your own browser. It is not sent to us.
• A "concept build" is a design we made to show our work. It is not a live site belonging to a client.
• Figures we show about our work for clients are totals taken from our systems on the day we last updated them. They describe what has happened and are not a promise of any result for you.
• The names and logos of our clients belong to them.

6. Sending us an enquiry

• Sending an enquiry does not make a contract and does not commit you or us to anything.
• Please do not send IC numbers, bank details or your staff's records through the enquiry form or by e-mail. If we need files from you, we will agree how you send them first.
• We handle the details you send us as our privacy notice says. The privacy notice is linked in the footer of the site.

7. Our content

The site, its text, designs, demos and code, and the Dawnbreaker name and mark, belong to us or to those who license them to us. You may view the site, share links to it and quote short parts of it with credit. You may not copy, scrape, republish or reuse the rest, or build on our demos, unless we agree in writing.

8. Using the site fairly

You must not:

• try to break into, probe, overload or disrupt the site or the systems behind it;
• send enquiries by automated means, or send false enquiries;
• pretend to be someone else; or
• use the site for anything unlawful.

We may block access to the site for anyone who does.

9. Accuracy, and what is not advice

We try to keep the site accurate and up to date, but it is general information. It may be incomplete or out of date, and we may change it without notice.

Where the site describes payroll, EPF, SOCSO, EIS, tax or employment matters, it is describing what our systems do. It is not legal, tax or accounting advice. For your own position, check with the authority concerned or your own adviser.

10. Other companies' services and sites

The site uses services run by other companies, such as web fonts, and may link to other sites. We do not control them and are not responsible for them. Our privacy notice says what those services receive.

11. Availability

We may change, suspend or withdraw the site, or any part of it, at any time. We do not promise that it will always be available or free of errors.

12. Our responsibility to you

Nothing in these terms takes away a right you have under Malaysian law that cannot be taken away, limits our liability where the law does not allow it to be limited (for example, for fraud, or for death or personal injury caused by negligence), or shortens the time you have to bring a claim.

Subject to that:

• you use the site at your own risk;
• we are not liable for loss that comes from relying on general information on the site in place of a written quote, an agreement or advice from us, from the site being unavailable, or from another company's site or service; and
• we are not liable for loss of profit, business or data, or for indirect loss, arising from your use of the site.

Our responsibility for a service we supply to you is set by our written agreement with you, not by these terms.

13. Changes to these terms

We may update these terms. The date at the top shows the latest version. If you keep using the site after a change, the new terms apply to you.

14. Law and courts

We are based in Malaysia. These terms are governed by the laws of Malaysia, wherever you use the site from, and the courts of Malaysia have exclusive jurisdiction over any dispute about the site or these terms.
